Public interest law movement which came to be known as public interest litigation (PIL) in India and England is perhaps the most striking innovation in Indian judiciary. It emerged as a part of the
legal aid movement directed towards the protection of the rights of minorities, women, children, the downtrodden and weaker sections of the society. The legal system had failed to protect their interests because of lack of access to justice, lack of standing or economic and other disablilities. The traditional legal or constitutional system could not provide quick relief in cases where interest of a large number of people was at stake. This led to the emergence of PIL. Judiciary came forward to provide quick remedy to suffering masses by relaxing the rule of ‘ locus standi ’. It means a right of appearance in a court of justice or before a legislative body on a given question. Such steps have led to the emergence of PIL and Judicial Activism.

Underdeveloped countries are most susceptible to inflation. Inflation in an underdeveloped economy generally occurs when there is an abnormal increase in the effective demand exerted mainly by the huge government expenditure under the planning process. However, the maintenance of stability in the domestic price level and a fixed, realistic exchange rate are very essential pre-conditions for achieving a maximum rate of sustained economic growth. This needs equilibrium of savings and investment. In an underdeveloped country, however, since the rate of savings is very low, government is usually tempted to raise the level of investment by means of credit expansion and deficit financing. Development efforts of this nature are generally confronted by inflationary price increases. To some economists, inflation is an inevitable price to be paid for economic growth. However, a heated controversy exists as to whether any relationship exists between inflation and economic growth. Nevertheless, it is widely agreed that the policy of development through inflation in underdeveloped countries can be successful and meaningful only if inflation is effectively controlled.

Credit growth of Indian commercial banks had been showing a decelerating trend from Dec., 2010 on the back of elevated inflation, interest rates and intensification of supply-side constraints. The year FY12 ended with bank credit growth of 19.3% and aggregate deposit growth of 17.4%. Even though the divergence between credit and deposit growth rates had narrowed during the first three quarters of FY12, it widened during the fourth quarter due to a sharper deceleration in deposit growth in Q4, FY12. This resulted in increased dependence of commercial banks on non-deposit sources of finance (i.e., borrowings) during Q4, FY12.While the deceleration in bank credit growth was contributed by all the sectors, i.e., agriculture, industry, services and personal loans, the RBI data showed that the deceleration was particularly sharp in agriculture, real estate, hotels and restaurants, professional services, telecommunication, power, cement, textiles, iron and steel and personal vehicle loans.

On the positive side, industrial sector has healthily grown at 5.8 per cent during April-August 2009 as against 4.8 per cent during the corresponding period of the last year. There has been an upturn in the primary capital market activity and a steady revival in debt and equity capital inflows since April, 2009. The banking system also has sufficient liquidity thanks to the excellent liquidity management done by the Reserve Bank of India (RBI) amidst a huge government borrowings programme. On the negative side, inflationary concerns have been mounting from the supply side and the growth in private consumption and investment demand still remains sluggish. The banking industry’s credit growth was just 10.8 per cent (y-o-y) as of October 9, 2009 as against 29.5% (y-o-y) a year ago. The Government is expecting a decline of 2.0 to 2.5 per cent in the agricultural GDP in 2009-10 due to the widespread drought conditions.
